FLEXFRIENDS REFERRAL PROGRAM
GENERAL TERMS AND CONDITIONS
Thank you for your interest in FlexFriends Referral Program (“Referral Program”)!
By participating in the Referral Program, you are agreeing to the terms and conditions set forth in the Referral Program, including the terms below (“Terms”). Any information which you provide us, including in connection with a Qualified Referral, is subject to FlexCare’s Privacy Policy to which you agree to be bound, including FlexCare’s Terms of Use. Collectively with the Terms, the foregoing represents the entire agreement between you and FlexCare in connection with the Referral Program.
Qualified Referral means a healthcare worker staffed by FlexCare who is: (i) an entirely new candidate and who is not in FlexCare’s applicant tracking system (“New Lead”); or, (ii) a candidate in FlexCare's applicant tracking system but who has never worked on an assignment with FlexCare and has not been considered as a prospect for an assignment for at least the last twenty-four (24) months (“Qualified Referral Period”). Any healthcare worker who has worked on assignment for FlexCare at any time shall not be deemed a “Qualified Referral.”
The Terms set forth herein apply to Qualified Referrals submitted until such date of any amendments to the Referral Program.
Program Eligibility
Who is Eligible to Participate?
Anyone over the age of 18 and who is a resident of the United States may refer a Qualified Referral. However, an internal staff employee of FlexCare is not eligible for the Referral Bonus.
Referral Requirements
You can refer a Qualified Referral through a FlexFriends Referral form on the flexcarestaff.com website or via the FlexCare 360 mobile app or directly to a recruiter (verbal or written). You will be deemed the first person to refer a candidate and therefore potentially eligible for the referral bonus if you first provide FlexCare with the Qualified Referral’s contact information during the Qualified Referral Period.
FlexCare reserves the right, in its sole discretion, to determine the original lead source.

In order for you to be eligible for a referral bonus as described in the table set forth above, the Qualified Referral must begin a FlexCare assignment within 180 days of the date Qualified Referral is recorded in FlexCare’s applicant tracking system per the Referral Requirements above. In the event a referrer qualifies for a bonus based on an extension, the referral must start their next assignment with FlexCare within 30 days of the last day of their preceding assignment.
Subject to the terms herein, if a Qualified Referral extends his or her original assignment with FlexCare to 13+ weeks, a referrer may qualify for an additional $250 bonus for a total of $500 (inclusive of the original bonus of $250 for the 8-12 week assignment). Similarly, the referrer may qualify for an additional $500 bonus for a total of $1,000 (inclusive of the original bonus of $500 for the 8-12 week assignment) if the Qualified Referral extends his or her Conversion Assignment from a competitor to 13 weeks or more. Except as otherwise provided herein, the referrer does not earn any bonuses upon an assignment extension.
FlexCare will determine, in its sole discretion, whether a referral is a Qualified Referral eligible for a bonus payout. FlexCare reserves the right to disqualify any referrer at any time for any reason from participation in the Program for reasons including but not limited to FlexCare’s good faith belief that referrer has violated these Terms, applicable law, or any of FlexCare’s policies. Subject to the terms herein, there is no limit to the number of referrals you can submit, or eligible bonus payouts for Qualified Referrals you may receive, while the Referral Program is in effect. Referrer is solely responsible for reporting and remitting all taxes in connection with any amounts received in connection with the Referral Program.
All bonuses will be paid only to the individual referrer and not to any other designated individual, entity, or assignee. Bonuses shall not be paid in connection with any contract assignment extension except as provided above.
Once the recruiter logs completion of the assignment by the Qualified Referral, the bonus will be paid to the referrer after the last week of the referral’s completed scheduled assignment. In the event the Qualified Referral does not complete the first contracted assignment due to cancellation by the facility (not because of the resignation or otherwise due to the actions of the referral) but begins a new assignment within 30 days of the last date of the first assignment, referrer shall be eligible for a bonus per the terms herein once the referral has completed at least 8 weeks at referral’s new assignment.
If the referrer is a current healthcare employee of FlexCare on assignment, referrer shall be paid the bonus during the same standard payroll cycle. If the referrer is not an employee of FlexCare, referrer shall be paid on monthly basis and shall receive a 1099.
*** Season of Giving Campaign: Completion Bonus***
Qualified Referrals who are referred during FlexCare’s 'Season of Giving’ campaign will earn a $250 completion bonus when they complete an 8+ week contract. The seasonal campaign will run November 13, 2024 through January 31, 2025.
No additional bonuses will be paid in connection with the Referral Program except as provided herein.
Limitations of Liability
To the extent permitted by applicable law and except as otherwise herein provided, you agree to release FlexCare and you agree that FlexCare shall not be liable for any amounts owed to you or your assigns including for direct, special, punitive, indirect or consequential damages in connection with the Referral Program. FlexCare’s maximum liability in connection with the Referral Program shall be any amounts owed to you in connection with the Qualified Referral.
Modifications and Jurisdiction
FlexCare reserves the right to modify these Terms or terminate the Program at any time, in its sole discretion, without notice. These Terms are governed by the laws of California, and the proper jurisdiction for any dispute shall be Placer County.
