Winner Selection

Winners will be randomly drawn on October 5, 2026 and contacted by phone or email. Winners must respond within three (3) business days to claim their prize.

PROMOTION DESCRIPTION: FlexCare LLC (“FlexCare”) is sponsoring the social media FlexCare Spread the Love (“Giveaway”) for an opportunity to win the following prizes: (1) grand prize of a $500 gift card of FlexCare’s choice; (2) Five (5) $100 gift cards of FlexCare’s choice; and, (3) FlexCare swag items of nominal value (“Prizes”).  No cash equivalent of the Prizes is offered, and FlexCare may provide any substitute Prizes in its sole discretion.  The Giveaway is only open to individuals who are currently licensed Allied healthcare workers, registered nurses and LVNs who are 18 years or older and legally residing in the United States.  FlexCare may require verification of your occupational status.  By participating in the Giveaway, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of FlexCare which shall be final and binding in all respects.  This Giveaway is in no way, sponsored, endorsed, or associated with Instagram, LinkedIn, Facebook/Meta, or Reddit.  This Giveaway is governed exclusively by the laws of the State of California and the United States.

ENTRY TIMEFRAME: The Giveaway begins on July 8, 2026 at 9:00am Pacific Time.  All entries must be received by 11:59:59 p.m. PT on September 30, 2026 (“Entry Period”).  

HOW TO ENTER THE GIVEAWAY: During the Entry Period, eligible entrants must: (1) create a positive post about their FlexCare recruiter or FlexCare; or, recommend a FlexCare recruiter or FlexCare generally in a Facebook/Meta, LinkedIn, Instagram, or Reddit (“Social Media”) post or comment; (2) take a screenshot of the post or comment; and, (3) send the screenshot via email or text to a FlexCare recruiter (“Entry”).  There is no limit to the number of Entries per participant.  Entries via Social Media must be received during the Entry Period.     

An entrant may also send a letter via U.S. mail with the entrant’s return address to FlexCare LLC, 1075 Creekside Ridge Drive, Suite 100, Roseville, CA 95678 in order to enter the Giveaway.  The email must include the entrant’s complete name and the current date as well as the subject line: “FlexCare Spread the Love Sweepstakes.” Entrants submitting entries which are incomplete will be disqualified.  Any mailed entries must be postmarked at least 7 days prior to the last day of the day entry period.  A Socia Media versus U.S. mail entry will not increase your chance of winning. 

FlexCare may prohibit an entrant from participating in the Giveaway or winning a prize if, in its sole discretion, FlexCare determines that said entrant is attempting to undermine the legitimate operation of FlexCare by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or engaging in unseemly conduct.

Please note that entries for one Entry Period will not roll over into any other sweepstakes or contests sponsored by FlexCare.        

FlexCare is not responsible for lost, late, illegible, stolen, incomplete, invalid, misdirected, or technically corrupted entries, which will be disqualified, or for problems of any kind, whether mechanical, human, or electronic. Proof of submission will not be deemed to be proof of entry in the Giveaway.  FlexCare has no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or changes to any entries.

SELECTION OF WINNER(S): Winner(s) will be selected on October 5, 2026 in a random drawing from all eligible entries.  Any Prizes are limited to one per household.  The decisions of FlexCare are final and binding in all matters relating to the Giveaway. Odds of winning depend on the number of eligible entries received. Within two (2) business days of the drawing date, the potential winner will be notified by email or phone call (“Notification”).  The potential winner will have three (3) business days from Notification to claim their Prizes.  Each entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all such requirements, including the waivers and releases set forth herein.  If Prize or Prize Notification is returned as undeliverable, if winner does not claim the Prize within three (3) business days after Notification or rejects the Prizes, or in the event of non-compliance with these Official Rules and requirements, such Prizes will be forfeited, and an alternate winner may or may not be selected from all remaining eligible entries. No compensation will be given in the event of forfeiture of the Prizes.  

CONDITIONS: All taxes, fees, and surcharges on prizes are the sole responsibility of winner. Prize(s) will be delivered via postal mail to the mailing address provided by the winners.  

LICENSE TO CONTENT; PUBLICITY; LIMITATIONS OF LIABILITY AND RELEASES: Acceptance of a Prize constitutes Prize winner’s permission for FlexCare to use Prize winner’s name, photos, likeness, voice, biographical information, statements and address (city and state) for advertising and/or any commercial purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.  By participating, entrants and winner(s) agree to release and hold harmless FlexCare, the companies affiliated with the Social Media, their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors, to the extent permitted by law, from any and all liability for loss, harm, damage, injury, cost, or expense whatsoever including, without limitation, rights of publicity, property damage, tax consequences and/or use or misuse of prize or participation in any Giveaway-related activity, and for any claims based on defamation, invasion of privacy, and prize delivery.  

Entrants also agree that FlexCare has not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose.

GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR FLEXCARE IN CONNECTION WITH THE GIVEAWAY SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. EXCEPT WHERE PROHIBITED, ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS INSTANT WIN OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA OR THE APPROPRIATE STATE COURT LOCATED IN SACRAMENTO COUNTY, CALIFORNIA; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS GIVEAWAY, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.  THIS PROVISION DOES NOT INTEND AND WILL NOT AMEND OR SUPERSEDE ANY ARBITRATION AGREEMENT BETWEEN ENTRANT AND FLEXCARE.
