OFFICIAL RULES:
1. Introduction: FlexCare Medical Staffing is sponsoring the “FlexCare 360 Mobile App Launch” giveaway, hereafter (“Contest”), for an opportunity to win one (1) iPhone 14 Pro Max (valued at $1,099), color ‘space black.’ Contest is only open to legal United States residents. Entries originating from any other jurisdiction are not eligible. This contest is governed exclusively by the laws of the United States. NO PURCHASE IS NECESSARY.
2. Eligibility: Entrants must be 18 years or older and a legal resident of the United States. Entrants must be a registered nurse (RN), therapist, or allied health professional. Entrants must follow FlexCare Medical Staffing on Facebook or Instagram, must register for FlexCare 360, download and use the FlexCare 360 mobile app. Void outside of the United States and where prohibited, taxed, or restricted by law. All federal, state, and local rules and regulations apply.
3. Contest Period: Eligible entrants can enter to win the Contest from August 9, 2023 to August 22, 2023. All entries must be received by 11:59:59 p.m. EST on August 22, 2023.
4. How to Enter: To enter, entrants must complete the FlexCare 360 registration, download and use the FlexCare 360 mobile app, and like the Contest social media post during the Contest Period. Only one (1) entry per person is permitted. Each FlexCare 360 registration actually completed and received by FlexCare Medical Staffing will count as one (1) entry. Entrants submitting entries via automated entry devices or programs will be disqualified. FlexCare Medical Staffing is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted, or garbled entries, which will be disqualified, or for problems of any kind, whether mechanical, human, or electronic. Proof of submission will not be deemed to be proof of entry in the Contest. Alternatively, entry can be made by sending an email to [email protected] with the subject line, “FlexCare 360 Mobile App Launch”. Email entries must be received by the end of the Contest period to be eligible. Email entries are limited to one (1) entry per eligible health professional.
5. Drawing: Winner will be selected on August 23, 2023 in a random drawing from all eligible entries, by FlexCare Medical Staffing, the decisions of which are final and binding in all matters relating to the Contest. Odds of winning depend on the number of eligible entries received. Within two (2) business days of the drawing date, the potential winner will be notified by email or phone call (“Notification”). The potential winner will have three (3) business days from Notification to claim their prize. Each entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules and winning is contingent upon fulfilling all such requirements. If prize or prize notification is returned as undeliverable, if winner does not claim the prize within three (3) business days after Notification or rejects the prize, or in the event of non-compliance with these Contest rules and requirements, such prize will be forfeited, and an alternate winner will be selected from all remaining eligible entries. No compensation will be given for prize forfeiture.
6. Prize: One winning entry will be chosen, and the winner will receive one (1) iPhone 14 Pro Max (valued at $1,099), color ‘space black.’ No substitutions of the prize by the winners are permitted, and FlexCare Medical Staffing reserves the right to substitute a prize of equal value due to prize unavailability. Prizes are not redeemable by prize recipient for cash value. All taxes, fees, and surcharges on prizes are the sole responsibility of winner. Prize will be delivered via postal mail to the mailing address provided by the winner.
7. Conditions: By participating, entrants and winner agree to release and hold harmless FlexCare Medical Staffing, Instagram, Facebook, their subsidiaries, affiliates, advertising and promotions agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any and all liability for loss, harm, damage, injury, cost, or expense whatsoever including, without limitation, property damage, personal injury, and/or death that may occur in connection with or participation in Contest, or possession, acceptance, and/or use or misuse of prize or participation in any Contest-related activity, and for any claims based on publicity rights, defamation, invasion of privacy, and prize delivery.
8. Miscellaneous: A potential winner may be requested to provide FlexCare Medical Staffing with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. A potential winner will be required to provide FlexCare Medical Staffing with a completed W-9 form prior to the prize being awarded. Additionally, the winner will need to provide registered nurse (RN), therapist, or allied health license verification prior to the potential winner being awarded the prize. FlexCare Medical Staffing assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of, or unauthorized access to, or alteration of, entries. FlexCare Medical Staffing is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by FlexCare Medical Staffing on account of technical problems or traffic congestion on the Internet or at any website, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Contest. FlexCare Medical Staffing may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten, or harass any other entrants or FlexCare Medical Staffing representatives. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, FLEXCARE MEDICAL STAFFING RESERVES THE RIGHT TO DISQUALIFY THE ENTRANT FROM THE CONTEST AND SEEK DAMAGES FROM SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
